| Spanish abstract | El artículo trata de una nueva postura de los derechos sociales por la adopción de la Carta de los Derechos Fundamentales de la Unión Europea jurídicamente vinculante. Los autores estudian si una facturación formal y la incorporación de los derechos sociales a un único catálogo significan también una revolución en cuanto a la protección de estos derechos (que se asocian tradicionalmente con un prudente acercamiento por parte de los estados nacionales así como de la comunidad internacional). Los autores responden a esta cuestión con un cierto grado de escepticismo. Apuntan a las limitaciones significativas que la Carta conecta con los derechos sociales - con el carácter incompleto del catálogo, las referencias al derecho nacional y el conocimiento de los derechos sociales como el principio del carácter de justiciabilidad limitado |
| English abstract | The research develops a new approach to the social rights deriving from the adoption of the fundamental rights chapter by the European Union with juridical correlation. The authors research if a formal implementation and incorporation of social rights to a single catalogue means a revolution in terms of the protection of these rights (traditionally have been cautiously approach by the national states and the international community). The authors answer this research question with a certain degree of skepticism. The research outlines the relevant limitations of the Chapter in connection with social rights - the incomplete essence of the catalogue, references to national law and understanding of social rights as the principle of limited justiciability |
