| Spanish abstract | La Corte Interamericana de Derechos Humanos, en una acción propia del celo en el debido cumplimiento de las obligaciones estatales derivadas de la Convención Interamericana de Derechos Humanos, ha dado vida a un control que ha llamado de convencionalidad. El presente artículo centra el problema de la existencia de este control en un asunto de competencia, mirado desde el Derecho Internacional y su circunscripción en el sistema chileno. Descartando la existencia, al menos actual de dicha competencia, se presenta una opción acorde con el Derecho Internacional y armoniosa con los ordenamientos nacionales, en la especie, el chileno: un control de compatibilidad, que permite abordar la compleja relación entre ambos derechos, permitiendo vías de cumplimiento de ambos |
| English abstract | The Inter-American Court of Human Rights, in an action proper to zeal in due fulfill ment of State’s obligations derived from the Inter-American Convention on Human Rights, has given life to a control that has been called of conventionality. The present article raises the problem of the existence of this control in a matter of competence, looked at from the International Law. Discarding the existence, at least current of this competence, presents an option in accordance with International Law and harmonious with national laws, a compatibility control, which allows addressing the complex relationship between both rights, allowing ways of complying with both |
