| English abstract | This article aims to clarify the most important concepts of dogmatic legal procedure, the one that is constituted before the state’s organs, about which there is much disagreement in legal doctrine. It focuses on the sequence of steps that the law professional must observe in relation to the legal texts claimed within that procedure, that is, to submit the formal sources of law, which have been chosen to base the arguments, to dogmatic tests rhetorically constructed: existence, validity, pertinence, vigor, incidence, technical efficacy, juridical efficacy and social efficacy (effectiveness). The rhetorical analysis carried out here, besides establishing a theoretical agreement about the most ancient of all methodologies, is pragmatic, because it aims to provide a solid roadmap to any law practitioners while exercising their job, explaining the steps from the legal texts to the decisions |
| Portuguese abstract | Neste artigo pretende-se esclarecer os conceitos mais importantes do procedimento jurídico dogmático, aquele que é constituído perante os órgãos do Estado, sobre os quais há muito desacordo na doutrina. Concentra-se sobre a sequência de passos que o profissional do direito precisa observar em relação aos textos jurídicos que alega dentro daquele procedimento, isto é, submeter as fontes formais do direito, que escolheu para fundamentar seus argumentos, a testes dogmáticos retoricamente construídos: existência, validade, pertinência, vigência, incidência, eficácia técnica, eficácia jurídica e eficácia social (efetividade). A análise retórica levada a efeito aqui, além de estabelecer um acordo teórico sobre a mais antiga das metodologias, tem caráter pragmático, na medida em que pretende fornecer um roteiro sólido a quaisquer profissionais do direito no exercício de seu trabalho, expondo os passos do texto jurídico à decisão |
