| English abstract | The ratification of ILO Convention 169 exposes one of the difficulties that the Concertación and post-military governments in Chile have faced with indigenous peoples, particularly the Mapuche. This article argues that the current Mapuche conflict is a reflection of the central problem of governments during the transition period in dealing with certain social demands, when these clash with the economic model and development projects. This situation has changed drastically with the social protests of 2019 and the constituent convention process. From this research we intend to clarify how the indigenous conflict in its first bases goes through another axis that should again become part of the political-legal debate, that is, to resolve the crisis of legitimacy suffered by Chilean public institutions, in the light of the situation unfolded above. We will argue why ILO Convention Nº169 does not in itself resolve the Mapuche conflict, which has gone from being outside the State to being part of its foundations; thus, in our opinion, the solution lies in the understanding and responsibility of political representatives that this situation is urgent, specific and challenging for democracies and their continuity. |
| Spanish abstract | La ratificación del convenio Nº 169 de la OIT expone una de las dificultades que ha enfrentado la concertación y los gobiernos post régimen militar en Chile con los pueblos indígenas, más particularmente con los mapuches. Este artículo sostiene que el actual conflicto mapuche es reflejo del problema central de los gobiernos durante el tiempo de transición para hacer frente a ciertas reivindicaciones sociales, cuando estas entran en pugna con el modelo económico y los proyectos de desarrollo. Esta situación ha cambiado drásticamente con el estallido social de 2019 y el proceso de convención constituyente. A partir de la presente investigación pretendemos esclarecer cómo el conflicto indígena en sus bases primeras transita por otro eje que debe volver a constituir parte del debate político-jurídico, esto es, resolver la crisis de legitimidad que sufren las instituciones públicas chilenas, a la luz de la situación antes desplegada. Argumentaremos por qué por sí mismo el Convenio de la OIT Nº169 no resuelve el conflicto mapuche, que pasa de estar fuera del Estado a inscribirse en sus fundamentos; así, a nuestro juicio, la solución pasa por la comprensión y responsabilidad por parte de los representantes políticos de que esta situación es urgente, específica y desafiante para las democracias y su continuidad. |
