Spanish abstract El desplazamiento forzado es una catástrofe humanitaria colombiana de carácter histórico, causado por los movimientos irregulares de los actores en conflicto, siendo el Estado un actor más que viola los derechos de esta población y es a su vez el responsable de la protección de los derechos humanos. Desafortunadamente el Estado al ser juez y actor del conflicto, obstaculiza la atención al desplazado, al exigirle una serie de requisitos que sabe que no puede cumplir, lo que da lugar a una nueva violación de derechos, por la falta de voluntad política de la ley 387 de 1997
English abstract The forced displacement is a Colombian humanitarian catastrophe of historical dimension, caused by the irregular movements of the actors in the conflict, being the State another actor which also violates the rights of this population and at the same time, is also responsible for the protection of the human rights. Unfortunately, the State being the judge and actor of the conflict hinders the attention of the displaced people, when a series of requirements is demanded of it and is aware that it is unable to accomplish them fully, which also gives rise to a new violation of rights, due to the lack of political will of the Law 387 of 1997
