| English abstract | The aim of this article is to investigate the main considerations about the Theory of Law originating from the debate between Hart and Dworkin. Initially, it discusses the way Hart understands the Theory of Law, stressing the source of his “open texture” view on the conception of law and, consequently, the judges‟ discretionary power. Then it analyzes Dworkin‟s main criticisms of Hart‟s Theory of Law, as well as the way Dworkin thinks that the problems of the Theory of Law can be solved |
| Portuguese abstract | Este artigo almeja investigar as principais considerações que dizem respeito à Teoria do Direito proveniente do debate entre Hart e Dworkin. Inicialmente abordar-se-á a maneira com que Hart compreende a Teoria do Direito, apontando a origem de sua concepção de “textura aberta” do Direito e, em consequência disto, do poder discricionário dos juízes. Em seguida, serão analisadas as principais críticas de Dworkin à Teoria do Direito de Hart, bem como de que forma ele entende que os problemas da Teoria do Direito podem ser resolvidos |
