| Spanish abstract | Siguiendo la teoría de la triple mimesis, planteada por Paul Ricoeur en Tiempo y narración, es posible detectar el nexo íntimo que guardan el derecho y la actividad humana de narrar. La Mimesis I, como red conceptual y anclaje de la trama narrativa, está dada en el derecho por la ley misma como forma de prescribir acciones jurídicamente deseables. La Mimesis II es la narración de unas acciones con relevancia jurídica, narración ésta que se realiza al interior del proceso judicial. La Mimesis III, finalmente, consiste en la aplicación de la hipótesis legal a las acciones que la concretan, y esto mediante el dispositivo de la sentencia como comprensión normativa y como medio para aplicar una sanción |
| English abstract | Following the theory of the triple mimesis, presented by Paul Ricoeur in Time and narration, it is possible to detect the intimate nexus that the law and the human activity of narrating maintain. Mimesis I, as conceptual network and anchorage of the narrative plot, is given in the Law by the law itself as a way to prescribe legally desirable actions. Mimesis II is the narration of some actions with legal relevance, narration which is carried out in the interior of the judicial process. Finally, Mimesis III consists of the application of the legal hypothesis to the actions that summarize it and this by means of the sentence device as regulatory comprehension and as a mean to apply a sanction |
