| Spanish abstract | En el derecho administrativo, el interés legítimo es un presupuesto de defensa contra actos gubernativos que no afectan directamente el patrimonio del ciudadano. Por su conducto se demandan acciones que el individuo considera perjudiciales a su persona, pero como parte de un colectivo social identificable. La reciente reforma a la Constitución Federal mexicana, considera obligatorios los derechos fundamentales contenidos en tratados internacionales, así, ahora los actos de autoridad pueden ser impugnados por violación de derechos humanos con base en el interés legítimo, reconociéndose un amplio espectro de derechos al individuo, como son un adecuado medio ambiente, vida sana, educación de calidad, adecuado transporte, salud y otros. | English abstract | In administrative law the legitimate interest is a defense presupposition against governmental acts that do not directly affect the legal rights of the citizen. Through him, the governmental acts that the individual believes harmful are demanded, but as part of an identifiable social group. Recent reforms to the Mexican Federal Constitution, consider the fundamental rights contained in international treaties mandatory, and now the acts of authority can be challenged for violation of human rights based on the legitimate interest, recognizing a broad spectrum of rights of the individual as they are a suitable environment, healthy living, quality education, adequate transportation, health and others. This article spreads and analyzes the relevance of the figure of legitimate interest, and how it will affect the actions of the authorities |
