| English abstract | Underwater Archaeology has been developing in Brazil, since the beginning of the 1990’s, although there are some specific precedents. Despite this branch of Archeology has been improving significantly in these almost 25 years, there is still a difficult scientific regulation process of its practice. One of the biggest challenges is the Brazilian’s legislation permissiveness confronting the international rules. While the UNESCO Convention on the Protection of the Underwater Cultural Heritage (2001) is a preservation instrument, not yet adopted in Brazil, the 7.542/1986 federal law, amended by 10.166/2000, allows material cultural heritage commercialization. This distortion creates difficulties for the practice of Underwater Archaeology in territorial waters and stimulates treasure hunting, once bad internal habits provide an unpleasant welcoming card |
| Portuguese abstract | A Arqueologia subaquática vem sendo desenvolvida, no Brasil, desde o início da década de 1990, embora haja antecedentes pontuais. A despeito desse ramo da Arqueologia ter avançado significativamente nesses quase 25 anos, ainda há um difícil processo de regulação científica de sua prática. Um dos maiores desafios é a legislação brasileira em relação às regras internacionais. Enquanto a Convenção da UNESCO para a Proteção do Patrimônio Cultural Subaquático (2001), ainda não adotada pelo Brasil, constitui instrumento preservacionista, a Lei federal 7.542/1986, alterada pela 10.166/2000, é extremamente permissiva, possibilitando a comercialização de bens arqueológicos. Essa distorção cria dificuldades para a prática da Arqueologia subaquática em águas territoriais e estimula a caça ao tesouro, uma vez que os maus hábitos internos fornecem desagradável cartão de visitas |
