English abstract t The article presents information and makes observations about the Supreme Court’s position as to the effectiveness of public policies through judicial process, particularly through class suits. We also examine the difficulty presented when one considers the need for effective public policies, given the constitutional principle of the separation of powers. The limits and possibilities the Supreme Court has adopted in this matter were also taken into account in this analysis. Our aim was to rely on its rulings by using an evolutionary interpretation of constitutional principles that can be applied to cases involving the implementation of public policies. Some considerations concerning the general position of the Court in matters regarding class suits were also made at the end. Finally, important precedents by the Supreme Court on matters regarding class suits for the implementation of effective public policies through judicial process were consigned in the text. Our findings and conclusions were presented at the end of the text in a final chapter
Portuguese abstract O artigo traz informações e formula observações a respeito do posicionamento do Superior Tribunal Federal (STF) quanto à efetivação de políticas públicas por meio do processo, em especial do processo coletivo. Procura-se ainda examinar no texto a dificuldade que se apresenta quando se pensa na necessidade de efetivação de políticas públicas a partir da limitação decorrente do princípio constitucional da separação de poderes. Foram igualmente levados em consideração, na análise realizada, os limites e possibilidades que o STF tem adotado nessa matéria, assentando em seus julgados uma interpretação evolutiva dos princípios e regras constitucionais que podem ser aplicados aos casos envolvendo a concretização de políticas públicas. Algumas considerações relativas à aplicação do posicionamento do STF ao processo coletivo também são feitas ao final. Foram consignados no texto precedentes importantes da Suprema Corte brasileira para a efetivação de políticas públicas por meio do processo jurisdicional. As conclusões foram apresentadas ao final do texto em item próprio
