| Spanish abstract | El presente trabajo tiene como objetivo demostrar la necesidad de completar y actualizar la legislación que establece el régimen de la participación de los atletas menores de edad en el deporte de alto rendimiento, que propicie la vigencia del principio del interés superior del menor y que logre un adecuado equilibrio en este ámbito entre los derechos de los atletas, los intereses de las organizaciones deportivas, conforme a las necesidades y principios de la sociedad cubana actual. Se han empleado como métodos de investigación científica: el análisis, la síntesis, la inducción, la deducción, el análisis exegético jurídico de la legislación civil, de familia, laboral y de Derecho deportivo. Se aporta un diagnóstico sobre los principales normativos que están presentes en el régimen de participación deportiva de los atletas menores de edad en el deporte competitivo |
| English abstract | The present work has as objective to demonstrate the necessity to complete and to upgrade the legislation that establishes the régime of the participation of the athletes smaller than age in the sport of high yield that propitiates the validity of the principle of the minor superior interest and that it achieves an appropriate balance in this environment among the rights of the athletes, the interests of the sport organizations, according to the necessities and principles of the current Cuban society. They have been used as methods of scientific investigation: the analysis, the synthesis, the induction, the deduction, the exegetic juridical analysis of the civil legislation, of family, labor and of Sport Law. A diagnosis is contributed on the main ones normative that are present in the régime of the athletes' sport participation smaller than age in the competitive sport |
