| Spanish abstract | El presente estudio tiene como objetivo el análisis de las relaciones labores de carácter deportivo con ocasión de la promulgación de la nueva Constitución de Cuba, ratificada el 10 de abril de 2019. Entre los antecedentes considerados en el presente estudio han sido valoradas las aportaciones de Pachot (2008), Rodríguez (2009), Ferriol (2009), Pérez (2015), Bernal (2016) y Lafita (2019). Siendo que el método empleado el de deducción comparativa entre las distintas fuentes consultadas, las cuales han permitido obtener como resultado, de manera general, una amplia panorámica del posicionamiento constitucional respecto de la nueva regulación que dicha norma suprema ofrece sobre el derecho al deporte respecto de las relaciones laborales en dicho ámbito del derecho y su posterior desarrollo normativo. Entre los resultados que se aportan aparece el alto grado de evolución conceptual que el derecho al deporte y a la educación física experimentan en el constitucionalismo cubano, siendo uno de los países pioneros en su con consideración constitucionalista, llamado con la nueva Constitución a fijar nuevos criterios de regulación de las relaciones laboral deportivas en el país, como acertada actualización de la evolución internacional del deporte |
| English abstract | The objective of this study is to analyze labor relations of a sports nature on the occasion of the promulgation of the new Constitution of Cuba, ratified on April 10, 2019. Among the background considered in this study, Pachot's contributions have been valued (2008), Rodríguez (2009), Ferriol (2009), Pérez (2015), Bernal (2016) and Lafita (2019). Since the method used is that of comparative deduction between the different sources consulted, which have made it possible to obtain, in a general way, a broad overview of the constitutional position regarding the new regulation that said supreme norm offers on theright to sport with respect to labor relations in this area of law and its subsequent regulatory development. Among the results that are provided appears the high degree of conceptual evolution that the right to sports and physical education experience in Cuban constitutionalism, being one of the pioneer countries in its constitutionalist consideration, called with the new Constitution to establish new criteria of regulation of sports labor relations in the country, as a successful update of the international evolution of sport |
