| Spanish abstract | Los seres humanos decidieron unirse en sociedad para el progreso común e individual, formando para ello el Estado y concediéndole a éste la facultad de preservar el bienestar social, mediante la punición y prevención de conductas criminales; empero, al existir diversos grados de violación de las reglas sociales, surge también la posibilidad de sancionar de formas distintas dichas transgresiones. La finalidad primordial del Estado es la prevención del actuar criminal y el conseguir el beneficio social, en consecuencia, debe tratarse de reinsertar al causante de la conducta antisocial en la sociedad; sin embargo, existen sujetos que cometen actos bastante graves o bien que son reiterativos en la comisión de conductas antisociales, a los cuáles habría que preguntarse si es conveniente, o no, el aplicarles la prevención especial negativa, es decir, la inocuización |
| English abstract | Humans decided to join society for common and individual progress, forming the State and granting it the power to preserve the social welfare, through the punitive and prevention of criminal behaviour; However, there are varying degrees of violation of social rules, also arises the possibility of sanctioning such violations in different ways. The primary objective of the State is to prevent the criminal act and get the social benefit, therefore, must be reintegrate the cause of antisocial behavior in society.
