| English abstract | The conceptual and procedural framework of the Criminal Law has been built over the basics of essentialism, which means the man is free, therefore responsible of his own actions. To ponder about that assertion through the revision of the statements that validated his understanding as a discernment-gifted being, using some criticism of Michel Foucault to the humanism, gives the opportunity to question about hegemonic knowledge and practices in Law; being this the first stage of a critical exercise, essential within this field |
