| Spanish abstract | A mediado del año 2015 la Corte IDH dictó una de las sentencias más influyentes y significativas de su historia, en relación al derecho de expresión y libertad de prensa. La importancia de este precedente no sólo descansa en la magnitud de las reparaciones ordenadas, sino que también en el desarrollo y precisión de las implicancias del artículo 13 de la Convención IDH. Lamentablemente, la argumentación empleada por el Tribunal deja interrogantes sin explicitar, preguntas sin responder, y respuestas sin completar. En cierta medida, lo único que queda verdaderamente claro es que el Estado venezolano ha sido condenado, no así el qué ni el porqué. Por estas razones, en el presente artículo se evalúa la construcción de la sentencia en una búsqueda por identificar las falencias en la argumentación empleada y desentrañar las razones verdaderas que pueden haber motivado la resolución bajo análisis |
| English abstract | In mid-2015, the Inter-American Court of Human Rights issued one of the most influential and significant sentences in its history, in relation to the right of expression and freedom of the press. The importance of this precedent lies not only in the magnitude of ordered reparations, but also in the development and precision of the implications of Article 13 of American Convention on Human Rights. Unfortunately, the arguments used by the Court leave unanswered and unspoken questions and incomplete answers. To a certain extent, the only thing that is really clear is that the Bolivarian Republic of Venezuela has been condemned, but not what or why. For these reasons, the present article evaluates the construction of the sentence in a search to identify the shortcomings in the argumentation used and to unravel the true reasons that may have motivated the resolution under analysis |
