| Spanish abstract | El normativismo es un conocimiento disciplinario del derecho que lo observa como “orden coactivo de la conducta”. En cambio, el neoconstitucionalismo es un conocimiento complejo e interdisciplinaria que se propone superar el desorden social, mirando al derecho conformado por tres diversos discursos pero enlazados: a) el debate del jurista que se autoconoce con el legislador; b) las garantías de llegar a ser iguales en derechos y c) la teoría que toma el contenido de los dos ámbitos nombrados. La verdad del conocimiento jurídico neoconstitucionalista es la conformación de una sociedad pacífica. Sin embargo, el normativismo sigue vigente, de manera que la sociología disciplinaria sigue describiendo la violencia, y los mass media triunfalistas nos ubican en una ‘posverdad’ |
| English abstract | Normativism is a disciplinary knowledge of law that regards it as a “coercive order of conduct”. On the other hand, neoconstitutionalism is a complex and interdisciplinary knowledge that seeks to overcome social disorder, watching at the law made up of three different but linked discourses: a) the debate of the jurist who self-knows with the legislator; b) the guarantees of becoming equal in rights and c) the theory that takes the content of the two areas named. The truth of neoconstitutionalist legal knowledge is the conformation of a peaceful society. However, normativism remains in force, so that disciplinary sociology continues to describe violence, and the triumphalist mass media place us in a “posverdad” |
