English abstract The jurisprudential criteria that the Supreme Court of Justice of the Nation in Mexico has issued in relation to social networks and the data, means of evidence and evidence obtained from different digital platforms, such as Facebook, WhatsApp, Instagram among others, were analyzed, it was determined whether they fit the parameters regarding authenticity, obtaining, and offering that the legislation has established in the accusatory criminal process in Mexico. The objective was to identify the most common problems in the incorporation of digital evidence in the accusatory criminal process in Mexico. The method used was analysis, the documentary technique and the semi-structured interview technique applied to judges and trial lawyers who work in the adversarial criminal process.
Spanish abstract Se analizaron los criterios jurisprudenciales que la Suprema Corte de Justicia de la Nación en México ha emitido en relación a las redes sociales y los datos, medios de pruebas y pruebas que se obtienen de distintas plataformas digitales, como son Facebook, WhatsApp, Instagram entre otras, se determinó si se ajustan a los parámetros en cuanto a la autenticidad, obtención, y ofrecimiento que la legislación ha establecido en el proceso penal acusatorio en México. El objetivo fue identificar los problemas más comunes en la incorporación de las pruebas digitales en el proceso penal acusatorio en México. El método que se utilizó fue el de análisis, la técnica documental y la técnica de entrevista semi estructurada aplicada a jueces y abogados litigantes que laboran en el proceso penal acusatorio.
