| Spanish abstract | En este artículo se realiza una aproximación al ordenamiento jurídico que reguló las relaciones laborales en la época colonial. Su estructura tiene el siguiente hilo conductor: debate sobre la denominada leyenda negra, en el que se elucida las consecuencias devastadoras de la conquista y el resultado de un sistema laboral constituido por un hibrido entre el esclavismo y el feudalismo. Esos aspectos dieron lugar a la creación de normas relacionadas con la protección de la integridad física de los indígenas, vulnerada a raíz de las enfermedades que contraían por falta de salubridad y los malos tratos que recibían en las sementeras y en las minas |
| English abstract | This article makes an approach to the legal system that regulated labor relations in the colonial era. Its structure has the following guiding thread: debate about the so-called black legend, in which the devastating consequences of the conquest are elucidated and the result of a labor system constituted by a hybrid between slavery and feudalism. These aspects led to the creation of norms related to the protection of the physical integrity of the indigenous people, violated as a result of the illnesses that they contracted due to lack of health and the ill-treatment they received in the sementeras and in the mines |
