| Resumen en inglés | This essay intends to emphasize the straight connection between Constitution Law and Penal Law. It is a study concerning the constitutional limits of the “jus puniendi”. Therefore, it establishes two principles. The first one proclaims that the penal rule must be constructed according to the system of Constitutional values. The second principle assures that the constitutional parameters, that demarcate the “jus puniendi”, must be concretized by the legislator, when it creates the general rule, and by the judge, when enacting the individualized rule in the judicial decision |
| Resumen en portugués | O presente trabalho pretende realçar a estrita ligação entre o Direito Constitucional e o Direito Penal. É um estudo sobre os limites constitucionais do “jus puniendi”. A respeito, estabelece dois princípios. O primeiro proclama que a norma penal deve ser construída de acordo com o sistema de valores imanente à Constituição. O segundo assevera que os parâmetros constitucionais, que demarcam o direito de punir, devem ser concretizados pelo legislador, ao elaborar a norma genérica, e, pelo juiz ao criar a norma individualizada da sentença |
