| Resumen en español | La investigación se propone analizar el pasaje de la justicia de paz lega a la letrada a comienzos del siglo XX, hasta su instauración en 1934, enmarcado en un conflicto en el cual la “modernidad” debió sortear la denominada “tradición” y también la rutina y los intereses enquistados en un terreno difícil de remover. Interrogantes varios se desarrollaron en torno al concepto de Justicia y su alcance. El quid de la cuestión era conceptual y práctico: si la administración de justicia ofrecía doble faceta: científica y otra popular, o debía ser enteramente científica. El trasfondo permite apreciar el juego entre la función institucional o la función preventiva respecto a la cuestión social y a fortiori la necesidad de brindarle la mejor atención. | Resumen en inglés | The research aims to analyze the passage from the justice of peace to the learned justice at the beginning of the twentieth century, until its consecration in 1934, framed in a conflict in which “modernity” had to circumvent tradition and also routine and interests stuck in a difficult terrain to remove. Several questions were developed around the concept of Justice and its scope. The quid of the question was conceptual and practical: whether the administration of justice offered a double facet: scientific and popular, or should be entirely scientific. The background allows us to appreciate the interplay between the institutional function or the preventive function with respect to the so called social question and a fortiori the need to give it the best attention. In short, “learned” justice was imposed on the “peace” tradition and also on the routine and vested interests |
