| Resumen en inglés | The reparation of moral damages is typified in the laws of Bolivia; however, there is a void in the direction and specific criteria that define the determination and quantification of this type of damage, which generates the need to develop criteria to systematically address cases of moral damages. In this regard, the Inter-American Court of Human Rights (IACHR) has guidelines to systematize the processes referred to moral damages. The objective of this research is to develop a methodological system for the reparation of moral damages, based on the guidelines of the IACHR, which will allow judges in civil matters to guarantee the protection of the rights of the parties involved in the proceedings. It is a projective research of mixed design. The population consisted of 14 Judges specialized in Civil and Commercial matters and 4 judges of the Civil Chambers. The technique used was the survey and the instrument was a questionnaire to diagnose the need, usefulness and acceptance of the proposal. It can be concluded that there is no legal tool that facilitates the direct application by judges of international standards on reparation of damages based on the guidelines of the IACHR |
| Resumen en español | La reparación del daño moral está tipificada en las leyes de Bolivia; sin embargo, existe un vacío en el direccionamiento y criterios específicos que definan la determinación y cuantificación de este tipo de daño, lo que genera la necesidad de desarrollar criterios para abordar de forma sistemática los casos de daño moral. Al respecto la Corte Interamericana de los Derechos Humanos (CIDH) posee unos lineamientos para sistematizar los procesos referidos al daño moral. Esta investigación tiene como objetivo desarrollar un Sistema metodológico de reparación del daño moral, con base en los lineamientos de la CIDH, que permita a los Jueces en Materia Civil, garantizar la protección de derechos de los sujetos procesales. Es una investigación proyectiva de diseño mixto. La población estuvo constituida por 14 Jueces especialistas en materia Civil y Comercial y 4 vocales de las Salas Civiles. La técnica utilizada fue la encuesta y el instrumento un cuestionario para diagnosticar la necesidad, la utilidad y la aceptación de la propuesta. Se puede concluir que no existe una herramienta jurídica que facilite a los Juzgadores la aplicación directa estándares internacionales sobre reparación de daño con base en los lineamientos de la CIDH. |
