| Resumen en inglés | In today"s complex legal landscape, the interpretation of the law has become a fundamental tool to ensure the fair and consistent application of the rules. The objective of the study is to reveal the interpretative power of the Constitutional Court: The Ecuadorian case. The approach is qualitative, the interpretive paradigm, the method used is legal analysis. The research design is documentary, the technique and instrument for collecting information is content analysis. The qualitative sample was legal documents such as judicial rulings, saved votes and concurrent votes of the Constitutional Court of Ecuador. The results reveal that the interpretative power of the Constitutional Court of Ecuador needs a balance between the need for flexible interpretation and establishing clear limits to avoid excess power on the part of the Court. It is concluded that legal discrepancies are common, and constitutional regulations continue to be forged through legal argumentation and interpretation |
| Resumen en español | En el complejo panorama jurídico actual, la interpretación de la ley se ha convertido en una herramienta fundamental para garantizar la aplicación justa y coherente de las normas. El objetivo del estudio es develar la facultad interpretativa de la Corte Constitucional: El caso ecuatoriano. El enfoque es cualitativo, el paradigma interpretativo, el método empleado es el análisis jurídico. El diseño de investigación es documental, la técnica y el instrumento de recolección de información es el análisis de contenido. La muestra cualitativa fueron documentos legales como sentencias judiciales, votos salvados y votos concurrentes de la Corte Constitucional del Ecuador. Los resultados revelan que la facultad interpretativa de la Corte Constitucional del Ecuador necesita un equilibrio entre la necesidad de una interpretación flexible y establecer límites claros para evitar un exceso de poder por parte de la Corte. Se concluye que las discrepancias jurídicas son habituales, y se sigue forjando normativa constitucional desde la argumentación y la interpretación jurídica. |
