| Resumen en español | Como producto del derecho judicial, diferentes tribunales constitucionales europeos han desarrollado nuevos tipos de sentencias atípicas, diferentes de las tradicionales. Entre ellas, las "exhortativas" recomiendan al legislador (incluso al constituyente) dictar nuevas normas en reemplazo de las actualmente en vigor, para que estén bajo la Constitución. En el caso argentino, recientemente la Corte Suprema las ha admitido en un hábeas corpus colectivo destinado a mejorar la situación de detenidos en cárceles de la Provincia de Buenos Aires |
| Resumen en inglés | As a product of judicial decisions, several European constitutional courts have developped new varieties of judgments, different from the traditionals ones, called "non typical" or "manipulative" judgments. Among them, the "exhortative decisions" recommend the legislator (or the constitutional power) enacts new acts or bills repleacing the presents ones, in order that they respect the Constitution. In the Argentinean case, the National Supreme Court admitted them recently, in a "collective" and "corrective" habeas corpus, with the target of improve the conditions of confinement of persons in prisons or in detention centres in the police stations of the Province of Buenos Aires |
