| Resumen en inglés | The increase in the international flow of capital presents opportunities both to countries that send and to those that receive investments. The benefits that derive from this relationship, however, depend on the way this capital is used. The objective of this study is to evaluate the viability of the existing norms in agreements created to regulate this type of investment considering the current debate in Brazil for the creation of a new model to be used in agreements to govern the relationship between investors and States. We show the main rules and conventions negotiated in organizations such as the World Bank, the OECD and the WTO, whether Brazil decided or not to join them. The main objects of analysis are the model created by the United States, as well as the agreements in this area that were signed with the among Mercosur partners |
| Resumen en portugués | O aumento dos fluxos internacionais de capitais representa oportunidades importantes tanto para emissores como para receptores de investimentos. Os benefícios que advêm dessa relação, no entanto, dependem da forma como são utilizados os capitais transfronteiriços. No presente artigo, busca-se avaliar o cabedal normativo existente, já que está em curso no Brasil um debate sobre o melhor modelo a ser adotado para reger a relação entre investidores e os Estados. São estudadas as regras e convenções criadas por instituições como o Banco Mundial, a OCDE e a OMC, tenha ou não o Brasil optado por incorporar-se a essas iniciativas. Também é analisado o modelo criado pelos Estados Unidos, bem como os acordos firmados entre os sócios do Mercosul |
