| Resumen en inglés | International law is a limited legal order. Its limitations result from the basic characteristics of the international society: the fact that it is a horizontal society and the absence of a power center, a central political authority. The limitations are present in the very structure of the legal order, in the reach of its norms and in the functioning of its institutions. Besides the limitations that are inherent to international law, the relationship between this legal order and politics and the relative roles played by each of the two in organizing international society deserve to be analyzed. For this purpose, an exercise in comparing and differentiating between internal and international politics, understood as strategic interaction, is undertaken. A similar exercise is operated by comparing and differentiating between the interactions of politics and law in domestic and international societies. The limitations as well as the relationship between law and politics are illustrated by recent examples taken from the international relations scenario in the Middle East |
| Resumen en portugués | O direito internacional é direito e é reconhecido como tal pelos Estados e demais atores da sociedade internacional. É, no entanto, uma ordem jurídica limitada em virtude das características essenciais da sociedade em que atua: a horizontalidade e a ausência de poder central. As limitações se fazem sentir na estrutura do ordenamento, no alcance de suas normas e no funcionamento de suas instituições. Além da limitações próprias ao direito internacional, cabe analisar a sua relação com a política e o espaço relativo ocupado por cada um na organização da sociedade internacional. Para isso, aproxima-se e distingue-se a política, enquanto interação estratégica, no âmbito internacional, da política no âmbito interno assim como são traçadas as distinções entre a relação do direito com a política nas sociedades Estatais e na sociedade internacional. As limitações do direito internacional e relação deste direito com a política são ilustradas pelos exemplos recentes da relações internacionais tirados do cenário do Oriente Médio |
