| Resumen en español | El objetivo de la presente investigación es la realización de un análisis integral de las competiciones deportivas, teniendo en cuenta su dimensión multidisciplinar y el crecimiento integral que ha experimentado durante los últimos años. Con anterioridad, esta cuestión ha sido abordada por autores como: Barba Sánchez, R. (2010), Bermejo Vera, J. (2017) o García Caba, M. (2013). A pesar de estos estudios, el régimen jurídico actual de las competiciones deportivas parece no estar adaptado a las necesidades del futuro ni a las particularidades de algunas disciplinas deportivas. Como primeros resultados de esta investigación, queda constatada la necesidad de actualización de las estructuras organizativas y el reconocimiento de nuevas realidades competitivas en las legislaciones estatales. Además, la complejidad del sistema organizativo del deporte implica la adopción de una respuesta transversal por el legislador, capaz de resolver los conflictos que pudieran surgir entre los agentes de la actividad deportiva. El presente análisis jurídico en torno a los retos y posibilidades existentes con respecto al marco organizativo de las competiciones deportivas tiene como otra finalidad extraer unas conclusiones prácticas que contribuyan a una mejora del marco organizativo de las competiciones, todo ello a través del uso de un método deductivo y una visión comparada. Entre las conclusiones más destacadas de este estudio, deben señalarse el riesgo de fuga de potenciales talentos deportivos en caso de pervivencia de las actuales estructuras o las posibles novedades legislativas de carácter nacional sobre deporte |
| Resumen en inglés | The objective of this research is to carry out a comprehensive analysis of sports competitions, taking into account its multidisciplinary dimension and the comprehensive growth it has experienced in recent years. Previously, this issue has been addressed by authors such as: Barba Sánchez, R. (2010), Bermejo Vera, J. (2017) or García Caba, M. (2013). Despite these studies, the current legal regime for sports competitions seems not to be adapted to the needs of the future or to the particularities of some sports disciplines. As the first results of this research, the need to update organizational structures and the recognition of new competitive realities in state legislation is confirmed. Besides, the complexity of the sport's organizational system implies the adoption of a transversal response by the legislator, capable of resolving the conflicts that may arise betweenthe agents of the sporting activity. Other goal of this legal analysis regarding the existing challenges and possibilities regarding the organizational framework of sports competitions is to draw practical conclusions that contribute to an improvement in the organizational framework of competitions, all through the use of a method. deductive and a comparative view. Among the most outstanding conclusions of this study, the risk of flight of potential sports talents should be pointed out in the event of the survival of the current structures or possible new legislation of a national nature on sports |
