| Spanish abstract | Este trabajo pretende hacer una crítica a las teorías de la justicia contemporáneas y revaluar varios de sus fundamentos. Primero se aborda la teoría de Emmanuel Levinas sobre la responsabilidad incondicional por el otro, y se hace una fuerte crítica a sus postulados basándose en el psicoanálisis lacaniano expuesto por Slajov Zizek. Después se hace una crítica a la solución de justicia que plantea Zizek de una Justicia sin Cara, al no hacerle caso a Hegel en su afirmación que las concepciones de justicia se determinan a partir de la contingencia histórica y las funciones que ejerce una concepción de justicia en una comunidad. Teniendo esto en cuenta se propone reevaluar la forma como se han abordado las teorías de la justicia hasta ahora, ya que excluyen el devenir histórico que llevó a una concepción particular de justicia, al igual que las diferentes formas de justicia que se dan en una determinada comunidad y finalmente la base biológica de la ética. Teniendo en cuenta lo anterior se generan algunas bases ontológicas sobre lo que es la justicia y su relación con el derecho basándose en las últimas lecturas y obras de Jaques Derrida |
| English abstract | This work aims to criticize contemporary theories of justice and reevaluate some of its foundations. First it deals with the theory of Emmanuel Levinas on the unconditional responsibility for the Other, and makes a strong critique of their assumptions based on Lacanian psychoanalysis methodology exposed by Slajov Zizek. Following we criticize the solution posed by Zizek on a Faceless Theory of Justice by ignoring Hegels assertion that conceptions of justice are based on historical contingency and the functions that a particular conception of justice exerts in a community. With this in mind we proposed to reassess the way theories of justice have been considered so far, as they exclude history, the different forms of justice that occur in a particular community and the biological basis of ethics. Given the above we pretend to generate some ontological bases of Justice and its relationship to Law based on the last readings and works of Jacques Derrida |
