| Spanish abstract | El presente documento efectúa una revisión de la jurisprudencia constitucional boliviana en lo referente a la acción de libertad —antes denominado hábeas corpus— y busca y el principio de informalidad. En este sentido, con el trabajo se busca demostrar cómo el Tribunal Constitucional fue estableciendo diferentes reglas restrictivas al principio de informalismo que convierte la excepción en regla. El método utilizado fue el dogmático-jurídico al efectuarse un análisis teórico a partir de la revisión de jurisprudencia y normativa que concluye en la necesidad de reconducir la jurisprudencia constitucional existente hacia los propósitos del legislador constituyente al momento de crear y diseñar la acción de libertad y hacia la naturaleza especial de la protección de los derechos controvertidos —vida y libertad— |
| English abstract | This document is a review of the b olivian constitutional jurisprudence in reference to habeas corpus and the principle of informality. In this sense, the work seeks to demonstrate how the constitutional court was established at the beginning different restrictive rules of informality that makes the exception the rule. The oretical analysis was performed from the review of case law and regulations. It was concluded on the need to redirect existing constitutional jurisprudence to the legislature’s constitutional purposes when creating and designing the hábeas corpus and to the nature of the protection of the rights at issue, life and freedom |
