| Spanish abstract | En México, el Sistema Acusatorio en la administración de justicia se aplica como obligatorio a partir de junio de 2016 a nivel federal, con el propósito de crear nuevas formas y modelos de impartición de justicia, encaminados al fortalecimiento del Estado de derecho y a la protección de los derechos humanos, lo que exige la aplicación de una serie de recursos que permitan un conocimiento integral y profundo del asunto; en este sentido, un auxiliar indispensable en cualquier juicio legal, bien sea de tipo penal, civil o administrativo, son los dictámenes e informes de diferentes especialidades –estudios– periciales a los que recurre la autoridad para lograr un conocimiento más amplio del caso. En éstos la participación del profesional de Trabajo Social como perito tiene especial importancia, pues el proceso parte de un carácter socio-jurídico; de esta manera, el especialista deberá comprender y explicar el escenario del sujeto de intervención desde la perspectiva del individuo, su entorno y su vida cotidiana, por lo que centra su atención en el modo en que estos escenarios fueron construidos desde la familia, las instituciones o la sociedad, en cada uno de los casos.Para ser perito no es suficiente ser experto en la materia, sino que debe tener claridad acerca de su función como tal a partir de las normas jurídicas existentes, las cuales son reformadas con relativa frecuencia, lo que le obliga a mantenerse en continua actualización para estar en condiciones de cumplir con su objetivo |
| English abstract | In Mexico, the Accusatory System in Justice administration, is applied as mandatory since June 2016 at the Federal level, with the purpose of creating new forms and models of justice administration, so as to strength the rules and protection of Human Rights.It is required by the application of a series of sources that allow a comprehensive and in-depth knowledge of the situation. That is to say, a vital aid in any legal trial, no matter if it is criminal, civil or administrative that are the opinions and reports of different specialties –expert survey– to which the authority resorts to obtain a broader knowledge of the case.The participation of the professional in this field is of paramount importance, since the process starts from a socio-legal nature, and in this way the specialist must understand and explain the scenario of the subject of intervention from the perspective of the individual, their environment and his daily life, so he focuses his attention on the way in which these scenarios were built from the family, institutions and / or society, in each case.It is not enough to be an expert in the field, but you must be clear about your role based on the existing legal norms, which are reformed with relative frequency. This forces you to keep constantly updating to be in a position to fulfill its aim |
