| Spanish abstract | En la actualidad es común encontrar trabajos que hablen de los derechos humanos, pero son pocos los que abordan el problema de los derechos humanos en las mujeres indígenas. Sobre todo en México, país rico en diversidad cultural; se reconoce que el estado mexicano tiene oficialmente 62 lenguas indígenas. Sin embargo, ésta riqueza cultural y pluricultural se ve opacada por la gran diferenciación social y económica en que viven. Por tal motivo, la presente investigación dará un esbozo de los derechos humanos de las mujeres indígenas del sur del país; es decir, de los estados de Guerreo, Oaxaca y Chiapas. Para tal análisis es necesario recurrir a algunos instrumentos normativos internacionales y nacionales, que tengan que ver específicamente con los derechos humanos de las mujeres indígenas. El trabajo está dividido en tres apartados, el primero, corresponde a los instrumentos internacionales; el segundo, a los nacionales, es decir la Constitución Política de los Estados Unidos Mexicanos; el tercero, a las constituciones de los estados de Guerrero, Oaxaca y Chiapas. Aunque existan a nivel internacional, nacional, estatal normas que defienden los derechos de las mujeres indígenas, la problemática específica de la mujer indígena muestra que existen carencias jurídicas aún pendientes en cada uno de los estados analizados |
| English abstract | Academic papers on Human Rights are widely-available today; however there are relatively few papers on the Human Rights of women in Indigenous Communities. This is particularly true in Mexico. Mexico is a culturally-diverse country with 62 official Indigenous Languages. However this multicultural heritage is being diminished by the social and economic inequality that affects Indigenous Communities. For this reason the current study will outline the Human Rights of women in Indigenous communities in the southern states of Mexico: Guerrero, Oaxaca and Chiapas. To conduct this study it is necessary to draw on the national and international legal instruments that refer specifically to the Human Rights of women in Indigenous Communities. This study is divided into three sections. The first section examines international legal instruments. The second examines national legal instruments: the Constitution of the United States of Mexico. The third, and final, section examines the constitutions of the states of Guerrero, Oaxaca and Chiapas. Although indigenous women s rights are protected by state, national and international laws; the specific issues faced by women in indigenous communities prove that there are still unresolved legal issues in the state analyzed in this study |
