Spanish abstract Este trabajo tiene relación con la correcta determinación de la responsabilidad civil en el marco de la jurisdicción penal, porque si bien la normativa ecuatoriana: la Constitución, el Código civil, y el COIP, en general, garantizan la efectiva reparación de la victima o perjudicado; también se observa un problema de interrelación normativa en el ámbito de la legislación penal, que podría vulnerar estos principios y garantías. Este problema se daría porque el art. 78 num. 3 en una interpretación literal y sistemática (intra código) dejaría fuera de cobertura determinados hechos constitutivos de responsabilidad civil y generadores de la reparación, aunque no se pudiera afirmar la culpabilidad penal del autor del hecho o incluso la antijuridicidad penal del comportamiento. A este problema se ofrece una solución en este trabajo
English abstract This work is related to the correct determination of civil liability in the context of criminal jurisdiction, because although the Ecuadorian legislation: The Constitution, the Civil Code, and the COIP, generally, ensure effective redress for the victim or injured; we observed a problem of legal interrelations in the field of criminal law, which could undermine these principles and guarantees. This problem occurs because the Art. 78 num. 3 in a literal and systematic interpretation (intra code) leave out of cover certain facts constituting civil liability and generators repair although it could not confirm the criminal culpability of the perpetrator or even criminal behavior illegality. A solution to this problem is offered in this paper
