| Spanish abstract | El presente artículo aborda el tema de la reproducción asistida comentando las diferentes técnicas que posibilitan realizarla, como la inseminación artificial, fecundación in vitro y la maternidad subrogada o por sustitución. En el primer caso analiza las modalidades homóloga y heteróloga en que ésta puede producirse a partir de que el semen fecundante sea del esposo o de un tercero y valora el tratamiento que ha tenido en diversos países europeos y en Brasil, Argentina y Perú, en el continente americano. En el segundo caso valora igualmente las diversas tipologías que puede adquirir ésta: homóloga, heteróloga, post morten mediante la técnica de crioconservación; también analiza las modalidades de la fecundación in vitro con transferencia de embriones. Comenta los diversos problemas de filiación derivados de estas técnicas y las repercusiones éticas y sociales de las mismas. Concluye afirmando que con las técnicas de reproducción asistida y la clonación, se pervierten las relaciones fundamentales de la persona humana: la filiación, la consanguineidad, el parentesco, la paternidad y la maternidad |
| English abstract | The present article approaches the topic of the assisted reproduction commenting the different ones technical that facilitate to carry out it as the artificial insemination, fecundation in vitro, and the surrogate maternity or for substitution. In the first and second case analyzes the diverse forms and technical in that these can take place and it values the treatment that has had in diverse European countries and in Brazil, Argentina and Peru, in the american continent. In the third case the author comments the filiation problems that are derived of the same one. It is pronounced on the ethical and social repercussions of these tech-nical. It concludes affirming that with the techniques of assisted reproduction the human person’s fundamental relationships are perverted: the filiation, the consanguinity, the relationship, the paternity and the maternity |
