| Spanish abstract | A partir del análisis evolutivo de la teoría de la pena, haciendo énfasis en los caracteres que se le han atribuido, el autor se ubica en el debate actual acerca de la vigencia de las penas de muerte y de privación de libertad, como sanciones principales aún establecidas en los ordenamientos jurídicos penales nacionales, la primera en franco proceso de abolición y la segunda en una polémica crisis existencial. Concluye sus reflexiones personales en dirección no a la supresión de estas penas sino encaminado a su perfeccionamiento |
| English abstract | Starting from the evolutionary analysis of the theory of the pain, making emphasis in the characters that have been attributed, the author is located in the current debate about the validity of the death penalties and the privation of freedom, like even established main sanctions in the national penal juridical classifications, the first one in franc process of abolition and the second in a polemic existential crisis. Concludes their personal reflections in address there is not the suppression of these hardships but guided to their improvement |
