| Spanish abstract | El autor ha elegido el término derrota para significar el curso que está siguiendo el derecho penal moderno y asumir que los principios que garantizan un adecuado proceso con los que se ha querido rodearlo, saltan hechos añicos en cuanto chocan con lo que se denomina el “problema penal de nuestro tiempo”, vaga etiqueta que acoge a los más variados fenómenos —criminalidad organizada, miedo urbano o inseguridad, movimientos migratorios imparables, desarrollo tecnológico, aumento del riesgo, etc.— que tienen en común algo de la mayor importancia: que frente a esas realidades el discurso del jurista respetuoso con los postulados del estado de derecho social y democrático es tomado como un mero arte cultural que no puede pretender ser una “herramienta” útil en la lucha contra el crimen |
| English abstract | The author has chosen the I finish defeat to mean the course that is following the modern Criminal law and to assume that the principles that guarantee an appropriate process with those that one has wanted to surround it, made bits jump as soon as they collide with what is denominated the “penal problem of our time”, he wanders it labels that it welcomes to the most varied phenomena —organized crime rate, urban fear or insecurity, unstoppable migratory movements, I develop technological, I increase of the risk, etc— that have something of the biggest importance in common: that in front of those realities the respectful jurist’s speech with the postulates of the State of social and democratic Right is taken as a mere cultural art that cannot seek to be a “tool” useful in the fight against the crime |
