| Spanish abstract | Existe un consenso entre los penalistas de que es imposible controlar eficazmente el crimen organizado sin utilizar nuevas formas en el proceso penal. En este sentido las transformaciones en el ámbito procesal son importantes; sin embargo, el desarrollo de estas nuevas vías en el proceso no pueden ni deben violar garantías que son fundamentales. El afán de lograr seguridad y una supuesta eficacia en el proceso penal no justifican que se violen estos principios esenciales. En el presente trabajo se examinan aquellos aspectos más novedosos que hoy, de una forma u otra, son aceptados en el proceso penal para enfrentar las peculiaridades del crimen organizado |
| English abstract | A consent exists among the penologists that it is impossible to control the organized crime efficiently without using new forms in the penal process. In this sense the transformations in the procedural environment are important, however the development of these new roads in the process are not able to neither they should violate covenants of title that you/they are fundamental. The desire to achieve security and a supposed effectiveness in the penal process doesn’t justify that these essential principles are violated. Presently work is examined those more novel aspects that today, in a way or other, they are accepted in the penal process to face the peculiarities of the organized crime |
