| Spanish abstract | El presente artículo aborda el problema que gira en torno a los derechos fundamentales en los menores de edad, cuestión que ha desarrollado la teoría constitucional en contraposición al entendimiento de que los menores no poseen capacidad para ejercer derechos por sí mismos. Sobre esta cuestión el artículo desarrolla diversos nudos conceptuales importantes: la distinción entre la titularidad y el ejercicio de un derecho y entre capacidad jurídica y capacidad de obrar, el margen de actuación de un tercero representante legal del menor a fin de que su actuación no defraude el interés de aquél, la relación entre titular del derecho y quien fácticamente realiza parte de su contenido, la comprensión de que para el derecho existe sólo el interés del titular del derecho que es también del ejercicio, la diferencia entre capacidad iusfundamental y capacidad de obrar infraconstitucional, la posibilidad de que el menor pueda ejercer sus derechos de forma autónoma o heterónoma, el concepto de interés del menor, piedra angular de toda la regulación jurídica de la minoría de edad y la posibilidad de delimitación y limitación de los derechos fundamentales durante la minoría de edad como consecuencia del ejercicio de las potestades de protección. | English abstract | The present article approaches the problem that rotates around the fundamental rights in those smaller than age, question that has developed the constitutional theory in opposition to the understanding that the minor don’t possess capacity to exercise rights for if same. On this question the article develops diverse important conceptual knots: the distinction between the ownership and the exercise of a right and between artificial capacity and capacity of working, the margin of the minor third legal representative’s performance so that their performance doesn’t defraud the interest of that, the relationship among regular of the right and who he carries out part of its content, the understanding that for the right it only exists the interest of the holder of the right that is also of the exercise, the difference between capacity of constitutional range and capacity of legal range, the possibility that the minor can exercise his rights in an autonomous or not autonomous way, the concept of interest of the smallest angular stone in the whole artificial regulation of the age minority and the possibility of delimitation and limitation of the fundamental rights during the age minority like consequence of the exercise of the protection imperiums.
