| Spanish abstract | El presente artículo centra su atención en la mujer desde el punto de vista de género y la postura discriminatoria que ha sufrido en la historia de la civilización humana. En relación con esto valora las corrientes feministas surgidas en contracorriente, destacando en el campo bioético y biojurídico. Dentro de este último analiza la bioética del cuidado, cuyo objetivo es poner en el “banquillo del acusado” a la bioética humana general de tipo individualista, machista, neutral y abstracta, estando lo relevante no en la consideración de si el individuo es persona o no, sino más bien que ese individuo se encuentra en relación con otro, cuestión con que se asocia con la experiencia maternal o femenina del cuidado (procrear, alimentar, cuidar, educar) como eje de razón totalmente diferente captado por el sexo masculino. También valora la bioética de la libertad de la mujer que trata de establecer una reivindicación, entendida ésta no sólo como una emancipación, sino con niveles que alcanzan la liberación femenina del dominio patriarcal, logrando un acceso igualitario a los medios técnicos que rompan con las subyugaciones biológicas y reproductivas que impiden la consideración de una igualdad de géneros en la sociedad; aquí entran aspectos como: el poder de decisión de la mujer sobre su propio cuerpo que incluye el derecho al aborto, el derecho a la renta de vientres a través de una relación contractual de subrogación, la disociación de la dación de semen por un hombre y adjudicación de paternidad a otro, el derecho a la reproducción en solitario, prescindiendo de la heterosexualidad, el derecho femenino a la elección entre los embriones para seleccionar el que considere genéticamente más apto, una especie de hijos a la carta, etc |
| English abstract | The present article centers its attention in the woman from the gender point of view and the discriminatory posture that it has suffered in the history of the human civilization. In connection with this it values the arisen feminist currents, highlighting one in the field of the biology and the ethics and another in the field of the biology and the juridical thing. Inside this last it analyzes the focus of the care whose objective is to accuse the vision human general of individualistic, macho type, neutral and abstract, being not the outstanding thing in the consideration of if the individual is person or not, but rather that individual is it is in connection with other, question with which he associates with the maternal or feminine experience of the care (to procreate, to feed, to take care, to educate) as axis of completely different reason captured by the masculine sex. It also values the focus of the woman’s freedom that tries to establish a recovery, expert this I don’t only eat an emancipation, but with levels that they reach the feminine liberation of the patriarchal domain, achieving an equitable access to the technical means that break up here with the biological and reproductive subjugations that impede the consideration of an equality of goods in the society, aspects enters like: the power of the woman’s decision on their own body that includes the right to the abortion, the right to the rent of stomaches through a contract relationship, the right to the reproduction in solitary, doing without of the heterosexuality, the feminine right to the election among the embryos to select the one that considers genetically more capable in kind of a children to the letter, etc |
