| Spanish abstract | El surgimiento del comercio hace necesario cambiar las formas tradicionales de circulación de los bienes, por unas más ágiles: amparadas a la utilización de ciertos documentos que hoy en día se denominan “títulos valores”. Este artículo pretende dar cuenta de dicho proceso histórico de transformación, que desencadena el surgimiento del Derecho cambiario, además de estudiar los principios rectores de la materia, que no sólo son aplicables al ordenamiento jurídico costarricense sino también al colombiano, en la medida en que ambos ordenamientos, en materia de títulos valores, obedecen a la misma inspiración: el proyecto Intal, elaborado por el Instituto para la Integración de América Latina |
| English abstract | The emergence of commerce brings out the need of changing the traditional ways of good’s spread for a quicker one: a new way sheltered from some documents that nowadays are called “securities.” The purpose of this article is to show the historical process of the transformation explained above, which leads to the coming out of the exchange law; besides, the study of the main principles of the subject. Those principles are not only applicable to Costa Rican legal regulations, but for Colombian legal regulation too, because both regulations, when they are talking about “securities”, respond to the same inspiration: The project Intal, elaborated by the Institute for Integration of Latin America |
