| English abstract | The paper aims to analyze the configuration of the State of Unconstitutional Things (ECI) in the environmental field in the face of state inefficiency in combating deforestation in the Amazon region. Its objectives are: i) to approach the ecologicaldimension of the principle of human dignity and the importance of biodiversity; ii) to present the challenges related to deforestation in the Amazon and the public policies for environmental protection, and iii) to analyze the impacts resulting from the federal government's environmental management conducts within a perspective of the ECI configuration. Through a deductive approach and bibliographic and jurisprudential research, it is concluded that there is a need for the Judiciary to intervene in order to create minimum structuring mechanisms to allow society to combat and monitor the management of one of the greatest biodiversities in the world |
| Portuguese abstract | O trabalho visa analisar a configuração do Estado de Coisas Inconstitucional (ECI) na seara ambiental diante da ineficiência estatal no combate ao desmatamento na região amazônica. Tem como objetivos: i) abordar a dimensão ecológica do princípio da dignidade da pessoa humana e a importância da biodiversidade; ii) apresentar os desafios relacionados ao desmatamento da Amazônia e as políticas públicas de proteção ao meio ambiente, e iii) analisar os impactos decorrentes das condutas da gestão ambiental do governo federal dentro de uma perspectiva da configuração do ECI. Através de uma abordagem dedutiva e pesquisas bibliográfica e jurisprudencial, conclui pela necessidade de intervenção do Poder Judiciário no intuito de criar mecanismos estruturantes mínimos para permitir o combate e a fiscalização por parte da sociedade na gestão de uma das maiores biodiversidades do mundo |
