| English abstract | In this article, it is presented a critical mapping of the legislative proposals in progress in the Chamber of Deputies and in the Federal Senate related to affirmative actions in education, with emphasis on color or race. It is identified that most of theproposals negatively impact the sub-quotes for black and indigenous people, either through the suppression of the ethnic-racial sub-quota, or through the combined use of criteria for other social groups, notably income. It is remarkable that no proposal in the pipeline advocates affirmative action exclusively for subordinateracial groups. With regard to the revision of the Law n. 12,711/2012, scheduled for 2022, it is identified that the proposals presented so far do not aim to advance the current affirmative action policy, recommending its indefinite expiration date, at best |
| Portuguese abstract | Este artigo apresenta o mapeamento crítico das proposições legislativas, em tramitação na Câmara dos Deputados e no Senado Federal, que tratam de ações afirmativas na educação, com ênfase no recorte de cor ou raça. Identifica que a maioria dos projetos de lei afeta negativamente as subcotas destinadas a negras/os e indígenas, seja pela supressão da subcota étnico-racial, seja pela utilização combinada de critérios que beneficiam outros segmentos sociais, com destaque para renda. Chama a atenção que nenhum projeto de lei em tramitação prevê ações afirmativas apenas para grupos raciais subalternizados. No tocante à revisão da Lei n. 12.711/2012, prevista para 2022, o que se constata é que as proposições até agora apresentadas não visam a aperfeiçoar a política de ações afirmativas vigente, prevendo, na melhor das hipóteses, sua vigência por prazo indeterminado |
