| Spanish abstract | Con el propósito de zanjar la discusión sobre la existencia o no de un derecho humano a la educación superior, en este artículo se aborda la problemática desde el Derecho Internacional de los Derechos Humanos. La legislación provee de razones que objetivan el reconocimiento de tal precepto y establece su contenido mínimo, mismo que es analizado en el texto. A su vez, se enlaza la discusión a decisiones recientes de los tribunales federales de México. El texto tiene como fin demostrar que el poder judicial del país, con sus resoluciones en la materia, está reconociendo el carácter de derecho humano de la educación superior |
| English abstract | This article seeks to resolve the debate over the existence or not of a human right to higher education, by appealing to the perspective of the International Law of Human Rights. The legislation provides the main arguments substantiating this right and establishes its minimum content, the details of which are discussed in this text. The article also links those arguments to recent decisions by the federal courts in Mexico, in order to show that the country’s judiciary, with its relevant resolutions, is effectively recognizing the human right to higher education |
