English abstract | This article concerns a brief history of the pursuit of truth throughout human history noting that torture was a legally-permitted means whose contestation happened due to the Enlightment. The origin of the principle of self-incrimination is British in light of its historical particularities. Along with its own evolution, the principle is foreseen today even in a great deal of international statutes. In Brazil, prior to the alteration furthered by Law 10.792/2003, the principle had already found applicability through article 5, LXIII, in the Brazilian Constitution of 1988 and the Decrees 592 and 678 issued in 1992 |
Portuguese abstract | Traça breve histórico da busca da verdade dentro da história humana, constatando que a tortura era um meio legalmente admitido, cuja contestação se deu pelo movimento iluminista. É inglesa a origem do princípio contra a auto-incriminação, em face de suas peculiaridades históricas. Com sua evolução, o princípio hoje encontra previsão inclusive em diversos estatutos internacionais. No Brasil, antes da alteração promovida pela lei 10.792/2003, o princípio já encontrava aplicação por força do artigo 5º, LXIII, da Constituição Federal de 1988 e pelos Decretos nº 592 e 678, ambos de 1992 |
