| Spanish abstract | El autor se pregunta sobre las posibilidades y límites de mejorar la calidad de las leyes y el significado de las expresiones “calidad de la legislación” y “calidad de las leyes”. Seguidamente, a partir de una muestra de estudios sobre el tema, identifica el método de diagnóstico utilizado en ellos, hace un compendio de los principales problemas que afectan la calidad de las leyes y las soluciones propuestas para superarlos, y las pone en relación con las áreas de estudios que integran la Teoría de la Legislación. La principal conclusión es que la “calidad de las leyes” está asociada a factores consustanciales al Derecho moderno como su vinculación a las fuerzas políticas actuantes en la sociedad, su carácter formal-racional, su producción centralizada y burocrática y el lenguaje técnico-especializado y cuasi-formalizado en que se expresan |
| English abstract | The author wonders about the possibilities and limits of improving the quality of the laws and the meaning of the expressions “quality of the legislation” and “quality of the laws”. Then, from a sample of studies about the topic, identifies the diagnostic method used, draws a summary of the main problems affecting the quality of the laws and the proposed solutions to overcome them and set them, afterwards, in relation with the areas of study integrating the Theory of the Legislation. The main conclusion is that “the quality of the laws” is associated to consubstantial factors to modern law such as their involvement with the political forces acting in the society, their formal-rational character, their centralized and bureaucratic production and the specialized-technical and quasi-formalized language they use |
