| Spanish abstract | El presente artículo realiza una reflexión general de la relación del acceso a la justicia con la perspectiva de igualdad de género, donde nos expone el significado del entendimiento tridimencional del acceso a la justicia para la justicia de género, el paradigma de neutralidad de las normas, la imparcialidad entendida como intersubjetividad ecuánime y la incidencia del orden social de género en el acceso a los derechos. Señala que el acceso a la justicia puede ser entendida en tres dimensiones: a) el acceso formal: la consagración universalista del derecho y la entrada sin restricción a los tribunales; b) el acceso sustantivo que se refiere al contenido protector de las resoluciones recaídas sobre las pretensiones legítimas, y c) el acceso estructural que tiene que ver con el contexto social y económico que determina si se puede a acudir o no a un tribunal y la forma, condiciones y consecuencias de ese acudimiento. Esta concepción tridimensional del acceso a justicia compromete a mirar las desigualdades existentes en el país y la forma en que éstas inciden en los procesos de deducción de pretensiones legítimas |
| English abstract | This article makes a general reflection of the relationship of access to justice from the perspective of gender equality, where the meaning of the three-dimensional understanding of access to justice for gender justice is exposed, the paradigm of neutrality rules, fairness understood as fair intersubjectivity and social impact of gender order in access to rights. Points out that access to justice can be understood in three dimensions: a) formal access: the universal recognition of the right and unrestricted entry to the courts; b) substantive access refers to the protective content of the decisions delivered on legitimate claims, and c) the structural access it has to do with the social and economic context that determines whether if you can go or not to court and the form, conditions and consequences of that decision to attend to court. This three-dimensional concept of access to justice agrees to look actual inequalities in the country and the form how these are affecting the legitimate claims deduction processes |
