| Spanish abstract | Existen dos sistemas de seguridad comunitarios vigentes en las Américas –el Sistema Internacional de la ONU y el Sistema Hemisférico de la OEA–, que imponen obligaciones de diversa naturaleza a los Estados de la región. En ambos esquemas se ha generado un cambio de significado para las cuestiones de defensa y de seguridad después de la Guerra Fría, trasladándose el enfoque tradicional que apuntaba su preocupación por la preservación del Estado (la seguridad nacional), a una visión enfocada en la conservación de la vida y la dignidad humanas. En el sistema internacional la noción de "seguridad humana" dio origen a la doctrina actualmente en boga de la "responsabilidad de proteger" que exige que los Estados den protección a sus ciudadanos, pero que obliga al mismo tiempo a la comunidad internacional a monitorear los abusos que ocurran en esa esfera interna, considerando incluso la posibilidad de intervención coercitiva en casos de atentados graves contra las personas. En el sistema hemisférico, la nueva doctrina de la "seguridad multidimensional" propone enfrentar las amenazas tradicionales y los nuevos fenómenos delictivos trasnacionales, reforzando la gobernabilidad y el estado de derecho. Los derechos humanos superan de esta manera la consideración originaria de "limitación" del ejercicio (eventualmente abusivo) del poder, y se plantean además como criterios para la formulación de políticas de seguridad destinadas a la prevención de la delincuencia, la violencia y la inseguridad. La nueva dimensión de la seguridad –humana y multidimensional– otorga a la comunidad internacional un rol activo y estratégico en la protección de los derechos humanos, en la vigencia del derecho internacional humanitario y en la aplicación del derecho internacional penal |
| English abstract | Two security systems are coexisting in the Americas –The international system of the United Nations (UN) (and the hemispheric system of the OAS– both imposing obligations of different nature to the states of the region. After the Cold War era, there a was a change in the issues of security and defense, moving the traditional vision focused on the National Security (state-preservation), to a vision focused on the preservation of life and human dignity. In the International system the concept of "human security" set the basis to the actual doctrine for "protection responsibility", that force the states to give protection to their citizens, but that also forces the international community t monitor the abuses that may occur domestically, considering the possibility of coercive intervention incases of severe actions against the people. In the hemispheric system, the new "multidimensional security doctrine" makes a proposal to face the traditional threats and the new transnational criminal phenomena, by reinforcing governance and the state of right. In such scenario, human rights are one step above over the original consideration of "limitation" of the exercise of power, and also set the issue as criteria for the formulation of security policies to prevent criminal acts, violence and insecurity. The new dimension of security –human and multidimensional– gives the international community an active and strategic role regarding the human rights protection, forces both the international humanitarian law and the application of the international law code |
