| Spanish abstract | La constitución de una sociedad mundial trae consigo el desarrollo de operaciones jurídicas con un creciente carácter supranacional acopladas a las constelaciones jurídicas nacionales, aunque también con relativa autonomía de ellas. En este artículo se propone distinguir entre cuatro regímenes jurídicos: el nacional, el internacional, el supranacional y el neoespontáneo. El primero es el clásico modelo propio del estado nacional, el segundo se constituye por la asociación entre estados soberanos, el tercero surge de la delegación de potestad de estos estados a foros jurídicos especializados y el cuarto emerge sin vinculación al estado a partir de las operaciones autónomas de distintos espacios funcionales. Ejemplos característicos de este último caso, son la lex mercatoria, lex sportiva, lex digitalis, entre otros. El artículo revisa inicialmente la tesis de la sociedad mundial y luego, sobre ese horizonte, propone el despliegue de los cuatro regímenes jurídicos que dan forma a un derecho de la sociedad mundial |
| English abstract | The constitution of a world community brings along the development of juridical operations with a growing supranational character attached to the national legal constellations, though with relative autonomy from them. In this article it is intended to distinguish four legal systems. These are: The national legal system, the international, the supranational and the neo spontaneous one. The first one is the classical model characteristic of the national state, the second system is constituted by the association of sovereign states, the third one results from the delegation of power of these states to specialized juridical forums and the fourth system arises without any links to the state starting from the autonomous operations of different functional spaces. Characteristic examples of this last case, are the “lex mercatoria, lex sportiva, lex digitalis”, among others |
