| Spanish abstract | Con motivo de un proyecto de reforma al código penal el trabajo plantea el problema de la determinación del tratamiento más adecuado a la criminalidad habitual de carácter medio y grave. Ante ello, luego de revisar la discusión actual sobre los planteamientos monistas y dualistas, se defiende una alternativa que obliga a distinguir conceptualmente entre penas y medidas. Para completar el modelo se invocan además criterios generales como la prevalencia del carácter correctivo de la intervención por sobre lo meramente asegurativo; la imposición de medidas previo pronóstico de peligrosidad individualizado; la opción por la vicariedad de las respuestas sin descartar la acumulación siempre sujeta al principio de proporcionalidad; y finalmente la consideración de la ponderación de riesgo que representa el sujeto y su imputación a él mismo o la sociedad |
| English abstract | Due to a reformation project to the penal code the following document outlines the problem that lies in determining the most appropriate treatment to the habitual criminality rate for both misdemeanor and serious crime. Therefore, after revising the present discussion on themonist and dual(ist) approaches an alternative that forces to distinguish conceptually penalties as well as security measures. In order to complete the pattern, some general criteria are also considered. This is “the prevailing aspect” in the corrective character of the intervention over what was merely secure; the imposition of measures with an individual anticipated prognosis of dangerousness; the option for the vicariate of the answers without discarding the accumulation that is always subjected to the principle of proportionality; and finally the consideration of the pondering of risk which represents the individual as well as his or her imputation to it or society |
