| Spanish abstract | El consentimiento del interesado o titular del bien jurídico posibilita que el agente esté exento de responsabilidad penal. El consentimiento se denomina acuerdo si la conducta se dirige contra o prescindiendo de la voluntad del interesado y el libre ejercicio de la misma. Requisitos del consentimiento y acuerdo son titularidad, capacidad, libertad y conciencia, y exteriorización. El consentimiento es causal de justificación y el acuerdo una situación de atipicidad. El consentimiento debe extenderse al bien jurídico individual vida y porque ésta es disponible ya que un derecho a ella y que sólo impone un deber de vivir es negación de la libertad como valor superior y de la dignidad y el libre desarrollo de la personalidad. De lege ferenda debe establecerse cláusula general que reconozca el consentimiento del interesado como elemento que elimina la ilicitud de la conducta y, en consecuencia, no castigarse la muerte a ruego y la eutanasia y eliminarse el auxilio al suicidio |
| English abstract | Consent (of a concerned party) allows the execution of sanctionable conduct with the possibility of avoiding criminal responsibility. Consent is called a contract if the behavior is directed against or sets aside the will of the interested party and his or her freedom to exercise it. In order for this to occur, the following criteria are required: a consenting party, capacity, freedom, awareness, and manifestation. Consent would be the cause of justification and the contract would be of an irregular nature. Consent should extend to the individual legal asset (good) "life", since the right to life imposes a contractual obligation to live, denying, freewill, dignity and freedom of personal growth as superior values. De lege ferenda should establish a general clause that recognizes consent (of a concerned party) as an element that eliminates prohibition of conduct and consequently, not punish mercy killings and euthanasia and not eliminate suicidal aid |
