| Spanish abstract | El artículo 15 del Código Penal chileno dispone quienes son considerados autores de un delito y no refiere a los que cometen el hecho por medio de otro. Éstos, no obstante, fueron incluidos en el Proyecto de Código Penal de 1946 y en el Anteproyecto de Nuevo Código Penal (ANCP) de 2005, y se contemplan, de tiempo ya, en codificaciones penales extranjeras, v. gr., Alemania, Portugal, España. De la omisión pudiere colegirse que en Chile se constituye una laguna de punibilidad para el autor mediato. Mas, y acorde con la normativa vigente, toda inferencia de impunidad merece rechazo ya que, a fines de sanción, basta el correspondiente tipo penal de la Parte Especial, cuya aplicación no vulnera lex praevia, scripta, certa, y stricta, el llamado principio de legalidad, pues el pertinente castigo, junto con el ilícito al que pertenece y Tribunal que debe juzgar, se ha establecido con anterioridad a la perpetración |
| English abstract | Article 15 of the Chilean Penal Code, stipulates who are authors of a crime, without referring to those individuals that commit the crime through another individual. These are included in the Penal Code Project 1946 and in the first draft of the New Penal Code 2005 and have long since been contemplated in foreign legislations (i.e. Germany, Portugal, Spain). One could infer that there exists a window of impunity for the offender. However, in accordance with the current legislation, in all cases, the inference of impunity, should be rejected because at the end of the sanctioning process, all that is required is the corresponding penal category from the Special Part and that its application not vulnerate lex praevia, scripta, certa, and stricta. This is known as the Legal Principal, since the crime and sentence, just as the court called upon to pronounce judgment, are previously established |
