| Spanish abstract | En líneas generales, este trabajo analiza la utilización del referéndum popular para aprobar el Decreto Nº 3 y las bases comiciales, ambas inconstitucionales, propuestas por Chávez para preparar el camino hacia la Asamblea Nacional Constituyente. Otros temas son analizados por el autor, como la ilegitimidad de la Constitución Bolivariana de 1999, la presidencia de facto de Chávez entre agosto de 1999 y agosto del año 2000, y la extralimitación de funciones de la Asamblea Constituyente durante dicho período, suplantando al Poder Legislativo. La idea principal gira alrededor de la restricción al voto, colocada intencionalmente por Chávez en la base segunda de las bases comiciales, con el propósito de sacar ventaja a través de la estrategia electoral conocida como “Kinos”. El resultado fue un fraude electoral y la elección de la Asamblea Nacional Constituyente carente de legitimidad. La conclusión es que si tanto la Asamblea Nacional Constituyente como la Constitución Bolivariana de Venezuela de 1999 no tienen legitimidad de origen, el segundo y actual Gobierno de Chávez nacido dentro de dichos límites tampoco puede tenerla |
| English abstract | In general terms, this work analyzes the use of the popular referendum to approve Decree N° 3 and the comitial bases, both unconstitutional regulations proposed by Chavez in order to prepare the way towards a National Constituent Assembly. Others issues are analyzed by the author, such as the illegitimacy of the Bolivarian Constitution of 1999, de facto presidency of Chavez between August 1999 and August 2000 and the extralegal functions assumed during this period by the Constituent Assembly supplanting the Legislative Power. The main idea is about the restriction to vote intentionally placed by Chavez in the second base of the comitial bases in order to take advantage through the electoral strategy known as “kinos”. The result was an electoral fraud and the election of an illegitimate National Constituent Assembly. The conclusion is that if both, the National Constituent Assembly and the Venezuelan Bolivarian Constitution of 1999 have no origin legitimacy, the actual Chavez’s second government born within those boundaries must be illegitimate too |
